Terms of Use

This page describes the terms and conditions that govern your use of certain Degree HACKED, LLC products or services, including DEGREE HACKED.com and mobile applications, offered by DEGREE HACKED, LLC Company and its subsidiaries, (“DEGREE HACKED”, “us” or “we”).

PLEASE READ THESE TERMS CAREFULLY BEFORE USING ANY DEGREE HACKED PRODUCTS OR SERVICES, AS THESE TERMS AFFECT YOUR LEGAL RIGHTS.

IMPORTANT NOTICE - ARBITRATION AGREEMENT AND CLASS ACTION WAIVER: BY AGREEING TO BE BOUND BY THE TERMS OF SERVICE, YOU AGREE THAT ALL DISPUTES BETWEEN US WILL BE RESOLVED BY BINDING ARBITRATION, EXCEPT FOR CERTAIN LIMITED TYPES OF DISPUTES DESCRIBED IN SECTION 12 BELOW. YOUR AGREEMENT TO ARBITRATION MEANS YOU ARE GIVING UP THE RIGHT TO GO TO COURT AND THE RIGHT TO A TRIAL BY JURY, AND INSTEAD, DISPUTES WILL BE DECIDED BY A NEUTRAL ARBITRATOR. YOU ALSO AGREE THAT ALL DISPUTES BETWEEN US, WHETHER IN COURT OR IN ARBITRATION, WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND YOU ARE WAIVING YOUR RIGHT TO BRING OR PARTICIPATE IN A CLASS ARBITRATION OR CLASS ACTION.

If you reside outside of the European Economic Area, your acceptance of these Terms of Service constitutes your consent to the processing activities described in our Privacy Policy.

1. GENERAL RULES AND DEFINITIONS

1.1 If you choose to use certain DEGREE HACKED products or services displaying or otherwise governed by these Terms of Service, including DEGREE HACKED.com (the “Site”), DEGREE HACKED’s mobile sites and applications, any of the features of the Site, including but not limited to RSS feeds, APIs, and Software (as defined below) and other downloads (collectively, the “Services”), you will be agreeing to abide by all of the terms and conditions of these Terms of Service between you and DEGREE HACKED.

1.2 We may change, add or remove portions of these Terms of Service at any time by notifying you of the change in writing (including by email or by updating the date above after “Last Updated On”). Such changes will become effective immediately upon posting. It is your responsibility to review these Terms of Service prior to each use of the Site.

1.3 IF ANY OF THE TERMS AND CONDITIONS OF THESE TERMS OF SERVICE, OR ANY FUTURE CHANGES, ARE UNACCEPTABLE TO YOU, YOU MAY: (1) IF APPLICABLE, CANCEL YOUR ACCOUNT (SEE SECTION 10.1 REGARDING TERMINATION OF SERVICE) AND/OR (2) DISCONTINUE YOUR USE OF THE SERVICES. YOUR CONTINUED USE OF THE SERVICES NOW, OR FOLLOWING THE POSTING OF UPDATED TERMS OF SERVICE, WILL INDICATE ACCEPTANCE BY YOU OF SUCH TERMS OF SERVICE, CHANGES, OR MODIFICATIONS.

1.4 We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

1.5 Being exposed to advertising is a condition of accessing the Services.

2. CONTENT ON THE SERVICES

2.1 The contents of the Services, including the Site, are intended for your personal, non-commercial use. All materials published or available on the Services (including, but not limited to text, photographs, images, illustrations, designs, audio clips, video clips, “look and feel,” metadata, data, or compilations, all also known as the “Content”) are protected by copyright, and owned or controlled by DEGREE HACKED, LLC Company or the party credited as the provider of the Content. DEGREE HACKED, LLC Company also owns copyright in the selection, coordination, compilation, and enhancement of such Content (“Arrangement”). You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Service. Non-commercial use does not include the use of Content without prior written consent from DEGREE HACKED, LLC Company in connection with: (1) the development of any software program, model, algorithm, or other generative AI tool, including, but not limited to, training or using the Content in connection with the development or operation of a machine learning or artificial intelligence (AI) system (including any use of the Content for training, fine tuning, or grounding the machine learning or AI system or as part of retrieval-augmented generation); or (2) providing archived or cached data sets containing Content to another person or entity.

2.2 The Services and Content are protected by copyrights, trademarks, patents, trade secrets, database rights, sui generis rights and other intellectual or proprietary rights in or to the Services and Content pursuant to U.S. and international laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display (including framing and inline linking), communicate to the public or in any way exploit, any of the Content (or its Arrangement) or the Services (including Software) in whole or in part.

  1. Some of our Services have features and functionality powered by our trusted third-party AI providers (“AI Providers”). By utilizing our Services, you consent to sharing data that you provide to us, or that resides within your account, with our AI Providers for the purpose of enhancing features within our Services made available to you. In some instances, use of AI query features may be governed by the AI Provider’s terms of service and privacy policy. You understand and agree that content or responses generated by AI may contain inaccuracies and should never be relied upon without independent verification. DEGREE HACKED does not control the content or responses provided by AI Providers, and makes no representations or warranties about the accuracy or completeness of such content or responses (or the sites and sources accessed through such content or responses). You also agree not to enter sensitive personal information into any AI powered query.

3. USER GENERATED CONTENT: SUBMISSIONS INCLUDING COMMENTS, READER REVIEWS AND MORE

3.1 If you upload, post, send, or submit any content on the Services, you represent to us that you have all the necessary legal rights to upload, post or submit such content and it will not violate any law or the rights of any person. You shall not upload to, or distribute or otherwise publish to the Services any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material. You shall not impersonate anyone else or otherwise misrepresent your identity, affiliation or status. You agree not to provide material and misleading information knowingly and with intent to defraud. You shall not upload to, or distribute or otherwise publish to the Services any malware, viruses, spyware, or other malicious software or files to the Services. You shall not use automated means to upload to, or distribute or otherwise publish to, the Services any content.

Be courteous. You agree that you will not threaten or verbally abuse other members, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or “spam.”

Use respectful language. Like any community, the online conversation flourishes only when our members feel welcome and safe. You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services.

Debate, but don't attack. In a community full of opinions and preferences, people always disagree. DEGREE HACKED encourages active discussions and welcomes heated debate on the Services, but personal attacks are a direct violation of these Terms of Service and are grounds for immediate and permanent suspension of access to all or part of the Service.

We may use automated scanning and moderation technology to monitor users’ direct activities to identify any violations of these Terms of Service, to help ensure a safe and respectful experience for you and other users.

3.2 The Services may be used only in a noncommercial manner. You must not, without the express approval of DEGREE HACKED, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services. You may not use all or part of the Services to collect, store, or use any user information for any purpose not expressly permitted by these Terms of Service.

3.3 You acknowledge that any submissions you make to the Services (i.e., user-generated content including but not limited to: comments, forum messages, reviews, text, video, audio and photographs, as well as computer code and applications) (each, a “Submission”) may be used, edited, removed, modified, published, transmitted, and displayed by DEGREE HACKED and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. Submissions made to the Services may also be included in our RSS feeds and APIs and made available for republishing through other formats.

3.4 You grant DEGREE HACKED a perpetual, nonexclusive, world-wide, royalty-free, sub-licensable license to the Submissions, which includes without limitation the right for DEGREE HACKED, or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, communicate to the public, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or developed at any time, any Submission posted by you on or to the Services or any other website owned by DEGREE HACKED, including any Submission posted on or to the Services through a third party. Among other things, DEGREE HACKED licenses comments to third parties for academic, governmental, financial and corporate use. In these cases, steps are taken to remove personal information from such comments.

3.5 You are solely responsible for the content of your Submissions. However, while DEGREE HACKED does not and cannot review every Submission and is not responsible for the content of these messages, DEGREE HACKED reserves the right to delete, move, or edit Submissions that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, in violation of these Terms of Service, or otherwise unacceptable.

3.6 By making a Submission, you are consenting to its display and publication on the Site and in the Services and for related online and offline promotional uses.

4. PROHIBITED USE OF THE SERVICES

4.1 You may not access or use, or attempt to access or use, the Services to take any action that could harm us or a third party. You may not use the Services in violation of applicable laws, including export controls and sanctions, or in violation of our or any third party’s intellectual property or other proprietary or legal rights. You further agree that you will not attempt (or encourage or support anyone else's attempt) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Services, or any content of the Services, or make any unauthorized use of the Services. Without DEGREE HACKED’s prior written consent, you shall not:

(1) access any part of the Services, Content, data or information you do not have permission or authorization to access or for which DEGREE HACKED has revoked your access;

(2) use robots, spiders, scripts, service, software or any manual or automatic device, tool, or process designed to data mine or scrape the Content, data or information from the Services, or otherwise use, access, or collect the Content, data or information from the Services using automated means;

(3) use the Content for the development of any software program, model, algorithm, or generative AI tool, including, but not limited to, training or using the Content in connection with the development or operation of a machine learning or artificial intelligence (AI) system (including any use of the Content for training, fine tuning, or grounding the machine learning or AI system or as part of retrieval-augmented generation).

(4) use services, software or any manual or automatic device, tool, or process designed to circumvent any restriction, condition, or technological measure that controls access to the Services in any way, including overriding any security feature, bypassing or circumventing any access controls or use limits of the Services, or failing to abide by exclusionary protocols such as the Robots Exclusion Protocol or the Automated Content Access protocol (DEGREE HACKED’s robots.txt notice does not constitute DEGREE HACKED’s prior written consent under these Terms of Service);

(5) cache or archive the Content (except for a public search engine’s use of spiders for creating search indices solely for the inclusion of links and short, non-AI synthesized snippets of the Content in search results);

(6) take action that imposes an unreasonable or disproportionately large load on our network or infrastructure;

(7) do anything that could disable, damage or change the functioning or appearance of the Services, including the presentation of advertising; and

(8) perform text and data mining activities under Art. 4 of the EU Directive on Copyright in the Digital Single Market.

4.2 Engaging in a prohibited use of the Services may result in civil, criminal, and/or administrative penalties, fines, or sanctions against the user and those assisting the user.

5. REPRESENTATIONS AND WARRANTIES; INDEMNIFICATION; LIMITATION OF LIABILITIES

5.1 You represent, warrant and covenant that: (1) no materials of any kind submitted through your account will: (a) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights, or (b) contain libelous or otherwise unlawful material; (2) you are at least thirteen years old if you are in the USA, and sixteen years old anywhere else; and (3) if you are under eighteen years old, your parent or legal guardian has read these Terms of Service and agreed to them and your use of the Service. You hereby indemnify, defend and hold harmless DEGREE HACKED and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of: (1) any breach by you or any user of your account of these Terms of Service or the foregoing representations, warranties and covenants; or (2) your gross negligence or willful misconduct. You must cooperate as fully as reasonably required in the defense of any such claim. DEGREE HACKED reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

5.2 DEGREE HACKED does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, or distributed through the Services by any user, information provider or any other person or entity. DEGREE HACKED will not be liable to you or any other person as a result of a user’s interactions with other users. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information will be at your sole risk. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, THE SERVICES AND ALL SOFTWARE ARE DISTRIBUTED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WHILE WE TRY OUR BEST TO ENSURE THAT THE SERVICES ARE ALWAYS AVAILABLE, UP-TO-DATE AND CORRECT, DEGREE HACKED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, AND INACCURACIES IN THE CONTENT OR OTHER MATERIAL MADE AVAILABLE THROUGH THE SERVICES. YOU SHOULD NOT RELY ON THE CONTENT AS A SUBSTITUTE FOR, NOR DOES IT REPLACE, PROFESSIONAL LEGAL, FINANCIAL, TAX OR MEDICAL ADVICE. IF YOU HAVE ANY CONCERNS OR QUESTIONS ABOUT YOUR HEALTH OR THE CONTENT ON THE SERVICES, YOU SHOULD ALWAYS CONSULT WITH A PHYSICIAN OR OTHER HEALTH-CARE PROFESSIONAL. PRIOR TO THE EXECUTION OF A PURCHASE OR SALE OF ANY SECURITY OR INVESTMENT, YOU ARE ADVISED TO CONSULT WITH YOUR BROKER OR OTHER FINANCIAL ADVISOR TO VERIFY PRICING AND OTHER INFORMATION. WE WILL HAVE NO LIABILITY FOR INVESTMENT DECISIONS BASED UPON, OR THE RESULTS OBTAINED FROM, THE CONTENT PROVIDED IN THE SITE, THE CONTENT, OR THE SERVICES. NOTHING CONTAINED IN THE SITE WILL BE CONSTRUED AS INVESTMENT ADVICE. WE ARE NOT A REGISTERED BROKER-DEALER OR INVESTMENT ADVISOR AND DO NOT GIVE INVESTMENT ADVICE OR RECOMMEND ONE PRODUCT OVER ANOTHER. YOU HEREBY ACKNOWLEDGE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK.

5.3 IN NO EVENT WILL DEGREE HACKED, ITS AFFILIATES AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, ADVERTISERS, SUPPLIERS, CONTENT PROVIDERS AND LICENSORS (“DEGREE HACKED PARTIES”) BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANY OTHER PERSON AS A RESULT OF YOUR ACCESS OR USE OF THE SERVICES, SUBMISSIONS OR CONTENT FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST SAVINGS, LOST REVENUES, LOST GOODWILL, OR COMPUTER FAILURE OR MALFUNCTION (COLLECTIVELY, THE “EXCLUDED DAMAGES”). THESE LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON NEGLIGENCE, TORT, CONTRACT, OR OTHER THEORY OF LIABILITY, EVEN IF ANY OF DEGREE HACKED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN ANY OF THE EXCLUDED DAMAGES, AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN DEGREE HACKED PARTIES' LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.

6. REGISTRATION AND SECURITY

6.1 As part of the registration or account creation process, you will create login credentials by selecting a password and providing an e-mail address or, if applicable, by linking another account, such as your Apple, Facebook, YouTube or Google accounts. You also can be requested to provide certain registration information, which must be accurate and updated, or verify your account or contact information.

Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to the Services if you share your login credentials. You are responsible for maintaining the confidentiality of your password, which you will not have to reveal to any representative or agent of DEGREE HACKED. You may not: (1) select or use the login credentials of another person with the intent to impersonate that person; (2) use login credentials in which another person has rights without such person's authorization; or (3) use login credentials that we, in our sole discretion, deem offensive. Failure to comply with these requirements will constitute a breach of these Terms of Service, which may result in immediate suspense or termination of your account. You must provide us with accurate, complete, and updated registration information about yourself.

You consent to receive notifications from us electronically to the e-mail address you provide to us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form.

6.2 Please notify us of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.

6.3 You must be 13 years or older to use any part of the Services in the USA, and 16 years or older anywhere else. If you are less than 18 years of age and would like to use, subscribe or register to any part of the Services, please ask your parent or legal guardian to review and agree to these Terms of Service before you use any part of the Services or ask them to complete the purchase and/or registration on your behalf.

6.4 You are responsible for all usage or activity on your account with DEGREE HACKED, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity or activity that violates these Terms of Service, or other applicable terms and conditions may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law-enforcement agencies.

6.5 If your access to any Service has been provided by or through a third party (for example, your employer or an educational institution at which you are a student) (each, a “Client”), the Client may have provided us with information about you to enable us to provide you with access to the Services and distinguish you from other subscribers (such as your IP address, email address or name).

6.6. We cannot and do not guarantee that any of the Services will be free from viruses or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of the Services.

6.7. If there is a dispute between participants on this site, or between users and any third party, you agree that DEGREE HACKED is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release DEGREE HACKED, its subsidiaries, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.

7. FEES AND PAYMENTS

7.1. We reserve the right at any time to charge fees for access to portions of the Services or the Services as a whole. In no event, however, will you be charged for access to the Services unless we obtain your prior written agreement to pay such charges. Thus, if at any time we require a fee for portions of the Services that are now free, we will give you advance notice in writing of such fees. You may cancel your account at any time (see Section 10.1 regarding termination of service). All new fees, if any, will be posted prominently on the Site and in other appropriate locations on the Service. You must pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any digital products or services offered for sale through the Services by us or by any other vendor or service provider. All fees and charges will be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Services through your account.

7.2 Billing Cycle. If you elect to use Services which are subject to charge fees such will be billed at the beginning of the paying portion of each month ("Billing Cycle") until you cancel your membership. We automatically bill your payment method each month on the calendar day corresponding to the commencement of your paying membership ("Renewal Date"). For the avoidance of doubt, your services will automatically renew for another Billing Cycle, and will be charged at then-current rates, unless you cancel it prior to the Renewal Date.  All fees and applicable taxes are payable in United States dollars. Service fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular as indicated below, if your Payment Method has not successfully settled. In the event your paying services began on a day not contained in a given month, we may bill your Payment Method on a day in the applicable month or such other day as we deem appropriate. For example, if you started your membership or became a paying member on January 31st, your next payment date is likely to be February 28th, and your Payment Method would be billed on that date. Your Renewal Date is subject to change due to changes in your service. Visit the "My Dashboard" page on the Site to see the commencement date for your next Renewal Date. We may authorize your Payment Method in anticipation of service-related charges. As used in these Terms of Service, "billing" means a charge, debit or other payment clearance, as applicable, against your Payment Method.

7.3 Price Changes. We reserve the right to adjust pricing for any part of the Services in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes that correspond to the completion of a promotional offer and/or changing or adding a plan will take effect on the Renewal Date without any prior notice to you from us. Except as otherwise expressly provided for in these Terms of Service, any other price changes to your Services will take effect following email notice to you.

7.4 Promotions and Redemption Codes. We may offer a promotion, contest or coupon code that will provide a discount on your membership subscription. These redemption codes may only be redeemed at the Site. Redemption codes are non-transferable, may only be used once and cannot be combined with other codes or redeemed for cash. The validity of redemption codes may depend on the status of the member who redeems it. For example, an existing subscriber may not redeem a code providing a discount for a new subscription. Redemption codes may have an expiration date, after which time the code will not be valid or accepted by the Site. Redemption codes are provided for your use only, and you agree that you will not share any redemption codes with others, including by emailing codes to friends or family, sharing codes on social networking sites, or posting codes to third party websites that are not our Site unless we provide written approval via email or on our Site to do so. We may terminate any promotions and invalidate unused redemption codes in our sole discretion. A discount provided via a redemption code is only valid during your paid subscription. If you cancel your subscription, you also cancel the discount from the redemption code. Reactivating your subscription will not reactivate the discount from the redemption code; nor will it allow you to redeem a code for a discount for new subscribers. If you receive a promotion code through an offer from a third party, additional restrictions may apply. Certain promotions may have additional terms or requirements to satisfy to become eligible, such as promotions that authorize users to obtain a refund if unsatisfied with the Service within a limited time of the commencement of the subscription. Any such additional terms and requirements, such as requirements that you use a particular process or submit certain additional information, or take certain steps within a designated time period, will be made available to you at the time you redeem the promotion.

7.5 No Refunds. No refunds will be given in any circumstances, subject to any written promotional program refunds, as described above. At any time and for any reason, however, we may provide credits, discounts, or other considerations to some or all of our members ("Service Credits"). The amount and form of such Service Credits, and the decision to provide them, are at our sole and absolute discretion. The provision of Service Credits in one instance does not entitle you to Service Credits in the future for similar instances; nor does it obligate us to provide Service Credits in the future, under any circumstance. One such reason for Service Credit may be if you upgrade or downgrade your Services plan. You may receive a pro-rated Service Credit or charge, as applicable, of the previously paid monthly or annual fee for the remaining days of that month or year, to be applied against the new subscription amount to be charged to your Payment Method on your Renewal Date.

7.6 Payment Methods. You may edit your Payment Method information by visiting the "My Dashboard" page available at the Site. If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see "Cancellation" below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method. This may result in a change to your payment billing dates. If you signed up for the Services using your account with a third party (e.g., Facebook, PayPal, iTunes, or similar account) as a Payment Method and wish to cancel your membership with us, please follow the instructions from such third party (e.g., visiting your account with the applicable third party and turning off auto-renew for, or unsubscribing from, our Services). You may also find billing information about your membership by visiting your account with the applicable third party.

7.7 Cancellation. You may cancel your Service at any time by visiting the "My Dashboard" page on the Site. After cancelling your membership, you will continue to have access to the Services through the end of your Billing Cycle. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH SERVICE PERIODS.

8. THIRD-PARTY CONTENT AND LINKS TO THIRD-PARTY WEBSITES.

8.1 The Services contain links to third-party websites, services, resources, and advertisers (collectively, “Linked Content”). DEGREE HACKED does not control, endorse, sponsor, recommend or otherwise accept responsibility for any of this Linked Content. Because we are not responsible for the availability of these outside resources, or their contents or privacy practices, you should direct any concerns regarding any Linked Content to such site. When you access Linked Content, you accept that there are risks in doing so, and that DEGREE HACKED is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third-party website or service that you visit or utilize. Because we are not responsible for the availability of these outside resources, or their contents or privacy practices, you should direct any concerns regarding any Linked Content to such site.

In addition, DEGREE HACKED will not and cannot monitor, verify, censor, or edit the content of any third-party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third-party website or service.

Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that DEGREE HACKED shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

8.2 Third Party Relationships 

Our site and service include a variety of content related to educational institutions and technology companies, such as colleges, universities, and education technology companies, some of whom we have contractual relationships. For example, we have relationships with many third parties that provide the ability for users to transfer credits received through a third party service to satisfy an institutions degree requirements. Some third parties may also provide us with payments or other incentives when we refer prospective students or recommend the third parties services. We may also provide information through our site and services about third parties with whom we have no relationship. While we strive to provide content, information, and guidance that is useful and relevant, it is important that you are aware of our affiliations and relationships with these third parties, and the relationship between the products and services that we offer (including our various informational, guidance, and recommendation services) and the third parties we may reference on our site. By providing us with information about yourself and your educational interest and goals, you are authorizing us to provide that information to third parties (including third parties we have a relationship with) that may have programs or offerings. 

9. SOFTWARE LICENSES

We grant you a limited, revocable, and non-transferable license to use the mobile applications (“Apps”) on devices you own or have a legal right to use in accordance with these Terms of Service, and any additional terms specific to the particular application. You have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, provided to you in order to access the Services (“Software”). You may not sublicense, assign or transfer any licenses granted by DEGREE HACKED, and any attempt at such sublicense, assignment or transfer will be null and void. You may make one copy of such Software for archival purposes only. You may not otherwise copy, distribute, modify, reverse engineer, or create derivative works from Software.

10. TERMINATION; SURVIVAL

10.1 You may terminate your DEGREE HACKED account by calling Customer Care at ###-##-#### during limited hours (please see our international contact information if you are outside the U.S.) or using online cancellation site [LINK]. 

10.2 DEGREE HACKED may, in its sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, without limitation, breach or assignment of these Terms of Service, or other applicable terms and conditions.

10.3 The provisions of these Terms of Service will survive the termination of your account or access to all or part of the Services.

11. GOVERNING LAW; JURISDICTION

11.1 Any disputes arising out of or related to the use of the Site or Services that is not subject to arbitration as provided in Section 17, shall be brought in the state or federal courts located in the Northern District of California, Santa Clara, and you hereby irrevocably consent to the exclusive jurisdiction and venue thereof. These Terms of Services will be construed in accordance with the laws of the State of California without regard to its conflict of law principles.

11.2 Any claim or cause of action arising out of or related to use of the Services or these Terms of Services must be filed within one year after such claim or cause of action arose or be forever barred.

12. WAIVER OF CLASS ACTIONS; ARBITRATION

12.1 Generally. In the interest of resolving disputes between you and us in the most expedient and cost effective manner, and except as described in Section 17.b, below, you and Degree Hacked agree that every dispute arising in connection with these Terms of Service will be resolved by binding, individual arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms of Service, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS OF SERVICE, YOU AND DEGREE HACKED ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION TO ADDRESS CLAIMS ARISING HEREUNDER.

12.2 Exceptions. Despite the provisions of Section 12.1, nothing in these Terms of Service will be deemed to waive, preclude, or otherwise limit the right of either party to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in a court of law in aid of arbitration; or (iv) to file suit in a court of law to address an intellectual property infringement claim.

12.3 Arbitrator. Any arbitration between you and Degree Hacked hereunder will be settled under the Federal Arbitration Act and administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (collectively, "AAA Rules") as modified by these Terms. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting us directly. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

12.4 Notice of Arbitration; Process. A party who intends to seek arbitration must first send a written notice of the dispute to the other party by certified U.S. Mail or by Federal Express (signature required) or, only if that other party has not provided a current physical address, then by electronic mail ("Notice of Arbitration"). Degree Hacked's address for Notice is: Degree Hacked, Attn: Legal Department, XXXXXXXXX . The Notice of Arbitration must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ("Demand"). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within 30 days after the Notice of Arbitration is received, you or Degree Hacked may commence an arbitration proceeding. All arbitration proceedings between the parties will be confidential unless otherwise agreed by the parties in writing. During the arbitration, the amount of any settlement offer made by you or Degree Hacked must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. If the arbitrator awards you an amount higher than the last written settlement amount offered by Degree Hacked in settlement of the dispute prior to the award, Degree Hacked will pay to you the higher of: (A) the amount awarded by the arbitrator; or (B) $5,000.

12.5 Fees. If you commence arbitration in accordance with these Terms of Service, we will reimburse you for your payment of the filing fee, unless your claim is for more than $5,000, in which case the payment of any fees will be decided by the AAA Rules. Any arbitration hearing will take place at a location to be agreed upon in San Francisco, CA, but if the claim is for $5,000 or less, you may choose whether the arbitration will be conducted: (i) solely on the basis of documents submitted to the arbitrator; (ii) through a non-appearance based telephone hearing; or (iii) by an in-person hearing as established by the AAA Rules in the county (or parish) of your billing address. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburse Degree Hacked for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator's ruling on the merits.

12.6 No Class Actions. YOU AND DEGREE HACKED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER HEREUNDER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Degree Hacked agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

12.7 Modifications to this Arbitration Provision. If we make any future change to this arbitration provision, other than a change to our address for Notice of Arbitration, you may reject the change by sending us written notice within 30 days of the change to our address for Notice of Arbitration, in which case your account with Degree Hacked will be immediately terminated and this arbitration provision, as in effect immediately prior to the changes you rejected will survive.

12.8 Enforceability. If any section of Section 12 or the entirety of this Section 12 is found to be unenforceable, or if we receive an Opt-Out Notice from you, then the entirety of this Section 12 will be null and void and, in that case, the exclusive jurisdiction and venue described in Section 21 will govern any action arising out of or related to these Terms.

12.9 For all litigation regarding Excluded Claims and any other controversy or claim for which arbitration is denied, the sole jurisdiction and venue for such litigation will be an appropriate federal or state court located in the County of Santa Clara in the State of California.

12.10 All provisions of this Section 12 will survive termination of these Terms of Service and the Terms of Sale, your relationship with us, and/or your account or profile.

13. MISCELLANEOUS

13.1 These Terms of Service have been made in and will be construed and enforced in accordance with California law. Any action to enforce these Terms of Service must be brought in the federal or state courts located in Santa Clara, California.

13.2 Nothing in these Terms of Service will serve to preempt the promises made in our Privacy Policy.

13.4 You agree to report any violations of the Terms of Service to DEGREE HACKED as soon as you become aware of them. In the event you have a claim of copyright infringement with respect to material that is contained in a Service, please notify legal@degreehacked.com. (Please direct all general questions to Customer Care.)

13.5 Our failure to enforce any provision of these Terms of Service or to respond to a breach by you or other parties will not in any way constitute a waiver of our right to enforce subsequently any terms or conditions of these Terms of Service or to act with respect to similar breaches.

13.6 If a provision of these Terms of Service is held invalid or unenforceable for any reason, that provision will be deemed severable and must be construed in a manner consistent with applicable law to reflect, as nearly as possible, the intention of the parties. The validity and enforceability of any remaining provisions will not be affected, and those provisions will remain in full force and effect.

13.7 If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us the following information in writing to DEGREE HACKED's Copyright Agent (see 17 U.S.C. § 512(c)(3) for further detail). Please be advised that to be effective, the Notice must include ALL of the following:

  1. a physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed;
  2. a description of the copyrighted work that you claim has been infringed;
  3. a description of where the material that you claim is infringing is located on the Site
  4. your address, telephone number, and email address and all other information reasonably sufficient to permit us to contact you;
  5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you believe that any content or materials you uploaded, posted, or submitted to DEGREE HACKED Service, that were subsequently removed from DEGREE HACKED Service, or to which access was disabled, improperly removed or disabled, please provide the following Counter-Notification to DEGREE HACKED's Copyright Agent (see 17 U.S.C. § 512(g) for further detail):

  • your physical or electronic signature.
  • a description of the materials that have been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, and that you will accept service of process from the person who provided notification of the alleged infringement.

13.9 These Terms of Service are personal to you, and you may not transfer, delegate or assign these Terms of Service to anyone. Any attempt by you to assign or delegate these Terms of Service shall be null and void. Degree Hacked may assign these Terms of Service at its sole discretion.

13.10 You agree that, except as otherwise expressly provided in these Terms of Service, there shall be no third-party beneficiaries to these Terms of Service.

13.11 These Terms of Service, the Privacy Policy and other applicable Additional Terms constitute the entire agreement between you and Degree Hacked in connection with your use of the Site and the Services and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the subject matter contained herein.

14. SPECIAL TERMS

14.1 Beta Testing.

DEGREE HACKED may invite you to review and evaluate software, applications, downloads or other features prior to their public or commercial release (hereafter “Beta Test Services”). If you choose to participate in Beta Test Services, you agree to be bound by these Special Terms and to provide DEGREE HACKED with certain feedback and suggestions regarding your experiences while reviewing and evaluating the Beta Test Services (“Feedback”). DEGREE HACKED may ask you to enter into a confidentiality agreement for each specific Beta Test Service. If so, your participation as a tester (“Tester”) is subject to that confidentiality agreement, in addition to the following terms and conditions which apply to all Beta Test Services.

You further agree that the Beta Test Services and any materials in the Beta Test Services, including content (collectively, “Pre-Release Materials”), are confidential or proprietary information of DEGREE HACKED. You agree as a condition of participating in Beta Test Services to: (1) not copy or reproduce the Pre-Release Materials; (2) safeguard the Pre-Release Materials and prevent unauthorized access to, reproduction of, disclosure of and/or unauthorized use of, the Pre-Release Materials; and (3) if applicable, fully comply with the terms and conditions of the confidentiality agreement.

You agree that breach of the above obligations will cause irreparable harm to DEGREE HACKED, and DEGREE HACKED is entitled to (in addition to any other remedies available to it) injunctive or other equitable relief to prevent the breach or threatened breach of your obligations. Your obligation to keep the Pre-Release Materials confidential will continue until DEGREE HACKED publicly distributes or has otherwise disclosed to the public through no fault of yours, the Pre-Release Materials that you are testing.

Upon request, you agree to immediately delete all copies of the Pre-Release Material which DEGREE HACKED provided to you.

You are invited to use Beta Test Services for the sole purpose of evaluating the Beta Test Services and assisting DEGREE HACKED in identifying errors. Nothing in these Special Terms or these Terms will be construed as granting you any rights or privileges of any kind with respect to the Beta Test Services or other content. The Beta Test Services are provided on an “as is” and “as available” basis and DEGREE HACKED makes no warranty to you of any kind, express or implied.

By using the Beta Test Services, you agree that: (1) participating in Beta Test Services is at your own risk and you know that the Beta Test Services may include known or unknown bugs; (2) any status indicators or preferences saved within Beta Test Services may be erased at any time; (3) DEGREE HACKED has no obligation to make these Beta Test Services available with or without charge for any period of time, nor to make them available at all; (4) these Terms also apply to your use of the Beta Test Services; (5) if requested, you will keep all information about the Beta Test Services confidential as stated above; (6) any Feedback you provide will become the property of DEGREE HACKED without any right to compensation or other obligation from DEGREE HACKED; (7) DEGREE HACKED may (or may not) use or otherwise exploit all or part of your Feedback or any derivative of it in any manner or media now known without any further remuneration, compensation or credit to you; (8) your participation to the Beta Test Services is on a purely voluntary basis and in consideration of the opportunity to assist DEGREE HACKED with the Beta Test Services; and (9) nothing in these Special Terms or your participation in the Beta Test Services creates any employment relationship between you and DEGREE HACKED.

In case of conflict between these Special Terms and the rest of the Terms, these Special Terms will prevail.

Exhibit A

Degree Hacked Mobile App End User License Agreement

This Degree Hacked End User License Agreement (this "EULA") is a legal agreement between you and Degree HackedDegree Hacked, LLC ("Degree Hacked," "we," "us" and "our") related to your use of the Degree Hacked mobile application associated with this EULA (the "Mobile App"). By downloading and using the Mobile App, you acknowledge that you have read, fully understand, agree to, and will be bound by this EULA, and the Terms of Service. If you do not agree to be bound by this EULA, you will not be able to use the Mobile App and you should exit the Mobile App immediately.

1.     LICENSE AND GENERAL USE RESTRICTIONS

Subject to the terms of this EULA, Degree Hacked hereby grants you a limited, non-exclusive, and nontransferable license to download, install and use the Mobile App for your personal and non-commercial use on a mobile device owned or otherwise controlled by you ("Mobile Device"), and solely for its intended purpose, and for accessing and using those features of our service enabled through the Mobile App. You must comply with all applicable third party terms of agreement when using the Mobile App. Your use of the Mobile App must not violate the terms of your wireless data services agreement for the applicable Mobile Device.

2.     ACCESS TO SITE AND SERVICES

The Mobile App provides you with access to Degree Hacked's mobile sites and content (the "Site") and products and services accessible thereon ("Services"). Your access to and use of such Site and Services are governed by Terms of Service and Privacy Policy , and for the avoidance of doubt, this EULA is incorporated into, and made a part of, the Terms of Service, and this EULA will be deemed to constitute Additional Terms thereunder. For the avoidance of doubt, the disclaimers of warranties and liability, use restrictions, intellectual property provisions, agreement to arbitrate, and The Site and Services are based in the State of California in the United States and provided for access and use only by persons located in the United States. You acknowledge that you may not be able to access all or some of the Site and Services outside of the United States and that access thereto may not be legal by certain persons or in certain countries. If you access the Site and Services from outside the United States, you are responsible for compliance with local laws.

3.     MOBILE PLATFORMS

The Mobile App shall only be used on Apple Inc.'s ("Apple") iOS and Google Inc.'s ("Google") Android (collectively, "Mobile Platform").

If you use the Mobile App on a Mobile Device running Apple iOS, then the following terms and conditions apply: (a) you acknowledge this EULA is entered into between you and Degree Hacked only, not with Apple; (b) you shall only use the Mobile App on your Mobile Device in compliance with this EULA and applicable third party terms, including the Usage Rules set forth in the Apple App Store Terms of Service; (c) Degree Hacked, not Apple, is solely responsible for the Mobile App and any information or content received through the Mobile App or the services accessible through the Mobile App; and (d) you acknowledge that, in the event of any third-party claim that the Mobile App or your possession and use of the Mobile App infringes that third party's intellectual property rights, as between Degree Hacked and Apple, Degree Hacked, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

If you use the Mobile App on a Mobile Device running Android, then the following terms and conditions apply: Notwithstanding anything to the contrary in this EULA, if you use the Mobile App on a Mobile Device running Android, you acknowledge and agree that (x) the Mobile App relies in part on functionality provided by Google (the "Google Functionality"), (y) any information provided by you via the Mobile App may be shared with Google in connection with your use of the Google Functionality and (z) all such information shall be handled by Google in accordance with the then-current Google Privacy Policy (currently available at http://www.google.com/privacy.html), as may be amended by Google from time to time.

4.     CHANGES TO ACCESSIBLE SERVICES; SUSPENSION AND TERMINATION OF RIGHTS

Degree Hacked may, at any time, change, update, modify, suspend or terminate any service that may be accessed through the Mobile App including, without limitation, to improve a service or its functionality; add or remove access to a service; improve ease of use; correct an error or bug; prevent or discontinue harmful or improper access to services; prevent or discontinue unauthorized use of services; comply with a platform provider or government request; or comply with a statute or judicial order.

5.     INTELLECTUAL PROPERTY

You acknowledge and agree that the Mobile App is provided under license, and not sold, to you. You do not acquire any ownership interest in the Mobile App under this EULA, or any other rights thereto other than to use the Mobile App in accordance with the license granted, and subject to all terms, conditions, and restrictions, under this EULA. Degree Hacked and its licensors and service providers reserve and shall retain their entire right, title, and interest in and to the Mobile App, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in this EULA. You further agree not to modify, adapt, translate, prepare derivative works from, transmit, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any portion of the Mobile App.

6.     THIRD PARTY SOFTWARE

If you use the Mobile App on a Mobile Device running iOS or Android, the Mobile App includes certain library components, including: (a) Angular, Ionic, JQuery, ngCordova and Require.js, the third-party software applications, each of which is distributed to you under the MIT License, available at https://opensource.org/licenses/MIT; and (b) Cordova, LocalForage, LSCache, PhoneGap, and TypeScript, the third-party software applications, each of which is distributed to you under the Apache License, Version 2.0, available at http://www.apache.org/licenses/LICENSE-2.0.

7.     SUPPORT AND MAINTENANCE

Degree Hacked is not, and you acknowledge the Mobile Platform provider (e.g., Apple, Google) is not, obligated to provide any support or maintenance services to you related to the Mobile App. Any complaints or support requests related to the Mobile App may be reported to us by selecting the "Help" or "Support" links on the Site.

8.     EULA TERM AND TERMINATION

This EULA shall become effective upon your acceptance by downloading and using the Mobile App or using the Mobile App and shall remain in full force and effect thereafter until terminated as provided herein. You may terminate this EULA for convenience at any time by deleting the Mobile App from all Mobile Devices that you own or control. Degree Hacked may terminate this EULA for convenience at any time by terminating your access to the Mobile App. Notwithstanding the foregoing, with respect to any user, this EULA shall terminate without any further action needing to be taken by Degree Hacked upon a material breach of the terms of this EULA by you. Upon the termination of this EULA for any reason whatsoever all licenses granted hereunder shall immediately terminate you shall immediately cease and desist from all access to and use of the Mobile App, and shall immediately purge all copies of the Mobile App from your Mobile Devices. The terms set forth in the following paragraphs of this EULA shall survive the termination of this EULA for any reason: "INTELLECTUAL PROPERTY"; "WARRANTY/DISCLAIMER OF WARRANTIES"; "LIMITATION OF LIABILITY"; "INDEMNIFICATION"; "MANDATORY ARBITRATION"; "CALIFORNIA LAW AND JURISDICTION"; "SEVERABILITY; WAIVER" and "ENTIRE AGREEMENT/THIRD PARTY BENEFICIARIES."

9.     EXPORT CONTROL LAWS

You agree to comply with all United States and all other applicable laws, rules, and regulations relating to the export, re-export, or transshipment of the Mobile App.

10.     US GOVERNMENT RIGHTS

The Mobile App is commercial computer software, as such term is defined in 48 C.F.R. §2.101. Accordingly, if you are an agency of the US Government or any contractor therefor, you receive only those rights with respect to the Mobile App as are granted to all other end users under license, in accordance with (a) 48 C.F.R. §227.7201 through 48 C.F.R. §227.7204, with respect to the Department of Defense and their contractors, or (b) 48 C.F.R. §12.212, with respect to all other US Government licensees and their contractors.
